1. Acceptance of Terms
By accessing or using StatusPing ("the Service"), operated by Naptown Labs ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
StatusPing is an uptime monitoring platform that checks the availability and response time of your web endpoints, sends downtime alerts, and provides public status pages. The Service is available at statusping.naptownlabs.dev.
3. Accounts
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.
4. Plans and Pricing
StatusPing offers the following plans: Free ($0/month), Pro ($9/month), and Team ($29/month). Plan features and monitor limits are described on our pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.
5. Billing and Payments
Paid subscriptions are billed monthly through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time, and it will remain active until the end of the current billing period. Refunds are not provided for partial billing periods.
6. Acceptable Use
You agree not to use the Service to: monitor endpoints you do not own or have permission to monitor; conduct denial-of-service attacks or load testing; violate any applicable laws or regulations; attempt to gain unauthorized access to our systems; or resell the Service without our written consent.
7. Service Availability
We strive to provide reliable monitoring, but we do not guarantee 100% uptime of the Service itself. Scheduled maintenance windows will be communicated in advance when possible. We are not liable for any damages resulting from service interruptions or delays in alert delivery.
8. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. You retain ownership of the data you provide. We may collect and store monitoring results, response times, and incident data as part of delivering the Service.
9. Intellectual Property
The Service, including its design, code, and branding, is the property of Naptown Labs and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.
10. Limitation of Liability
To the maximum extent permitted by law, Naptown Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time through your account settings. Upon termination, your monitoring data will be permanently deleted within 30 days.
12. Changes to Terms
We may update these Terms of Service from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated via email or an in-app notice.
